Communication
All communication between boutiques and models/photographers MUST be done through Boutique Beauties. Models should not contact Boutiques directly to request or solicit for assignments. Boutiques should not contact models or photographers directly to request their services. This includes Facebook communication. Parties are permitted to write welcome messages to each other on Facebook, but should not solicit or suggest their services in any way. This policy is in place to prevent unwanted and unsolicited communication for all parties, insures the privacy and protection of all parties and eliminates confusion about assignments and responsibilities.
Payment of Fees
Models and photographers may choose the length of their contract and pay at the time of registration. When your contract is due to expire you will be sent a contract renewal notice. If you choose to extend your contract you must make payment before the date of expiration, as all listings become inactive on the date of expiration. If your listing expires and you choose to renew it at a later time, you will be able to make payment and your info will be available again. Boutiques must pay a yearly fee of $10 to maintain their account. The above terms also apply to boutique account expirations.
Copyright and Usage Rights
The photographer, not boutique or model, holds copyright to images. When images are submitted to Boutique Beauties, the assigned boutique is granted limited usage rights which allow them to use the images only for advertisement of their shop and products. The boutique may use the photos in print, media, digital, and web usages. The boutique may not sell or distribute the photos to other parties.
By submitting any photo to Boutique Beauties, you hereby grant to Boutique Beauties and its affiliates a royalty-free right to use, reproduce, edit, display, modify, publish and otherwise make use of the submitted photo in any and all media, throughout the world. In addition to other things, the rights granted to Boutique Beauties includes but is not limited to the right to resize, crop, censor, compress, edit, feature, caption, affix logos to, and to otherwise alter or make use of the submitted photo.
Boutique Beauties is committed to protecting photographers' copyrights. Each image submitter is required by US law to own the right to or to obtain permission to use any image before the image is uploaded to Boutique Beauties. Photographers: If you believe that your work has been copied in a way that infringes your copyrights, please contact us at info@boutiquebeauties.com and provide all relevant details.
Dissatisfaction Procedure
In the event that a boutique is not satisfied with photos provided by a model, the boutique must notify Boutique Beauties within 24 hours of receiving the photos. If the boutique does not so notify us, it will be assumed that they have accepted the images.
Complaints
Any cause for complaint should be reported to Boutique Beauties when it arises. Complaints cannot be considered in retrospect.
Liability
Boutique Beauties shall not be liable for any loss suffered by a boutique. In the event that an assignment is not completed and photos are not returned as expected when items are sent out, the model will be billed for the resale value of the merchandise.
Conflict of Interest
We reserve the right to deny or cancel the listing of any party whose own business presents a conflict of interest with Boutique Beauties (such as a competing listing service). It is our desire to work with everybody, but if the conflict of interest becomes a problem or if we foresee a problem we will deny the application or terminate the member's contract.
Termination of Contract
Boutique Beauties reserves the right to terminate the contract of any party without refund if any of the above mentioned guidelines are not followed, or for any other reason as we see fit. If a party wishes to cancel their own contract before it expires, they may do so and their information will be removed from the site, but no refund will be given.
Privacy Policy
Your privacy is very important to us. We maintain our information database privately and protect it with all reasonable security measures. Your personal information will not be shared or sold, except when an assignment is given and a package needs to be mailed. We have developed this Policy in order for you to understand how we collect, use, communicate and disclose and make use of personal information. The following outlines our privacy policy.
Before or at the time of collecting personal information, we will identify the purposes for which information is being collected.
We will collect and use of personal information solely with the objective of fulfilling those purposes specified by us and for other compatible purposes, unless we obtain the consent of the individual concerned or as required by law.
We will only retain personal information as long as necessary for the fulfillment of those purposes.
We will collect personal information by lawful and fair means and, where appropriate, with the knowledge or consent of the individual concerned.
Personal data should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up-to-date.
